"How many personal injury cases similar to mine have you handled?"
Look for specific experience with your type of accident (car, motorcycle, slip and fall, etc.)
"What is your fee structure? What percentage do you take?"
Most PI attorneys work on contingency (33-40%). Ask if the percentage changes if the case goes to trial.
"Who will actually be working on my case day-to-day?"
At larger firms, much of the work may be handled by paralegals or junior associates. Know who your point of contact will be.
"What do you think my case is worth? What is the realistic range?"
Be cautious of attorneys who give very high estimates upfront. A good attorney will give you a realistic range based on similar cases.
"How long do you expect my case to take?"
Most San Diego PI cases settle in 6-18 months. Cases that go to trial can take 2-3 years.
"Are you willing to take this case to trial if needed?"
Insurance companies offer better settlements when they know the attorney is willing and able to go to court.
What to Expect During the Consultation
Duration: Most initial consultations last 30-60 minutes.
Cost: Nearly all personal injury attorneys in San Diego offer free initial consultations. You should not be charged for this meeting.
The attorney will ask: Details about the accident, the extent of your injuries, what medical treatment you have received, whether you have spoken to insurance companies, and what documentation you have.
You should leave knowing: Whether the attorney thinks you have a viable case, their honest assessment of what it could be worth, their fee structure, and the next steps if you decide to hire them.
No pressure: A reputable attorney will not pressure you to sign a retainer agreement on the spot. Take your time, meet with multiple attorneys if needed, and choose the one that feels right.
